LD Sussex Decoration Ltd Terms of Service

1. Introduction
These Terms of Service ("Terms") govern the provision of painting and decorating services by LD Sussex Decoration ("we", "our", "us") to our customers ("you", "your"). By accepting our quotation or engaging our services, you agree to be bound by these Terms.
2. Services
2.1 We provide professional painting and decorating services for residential, commercial, and listed properties as detailed in our written quotation.
2.2 Any additional work not specified in the original quotation will require written agreement and may incur additional charges.
2.3 We reserve the right to refuse or discontinue service if working conditions are deemed unsafe or if required preparatory work has not been completed as agreed.
3. Quotations and Pricing
3.1 All quotations are valid for 30 days from the date of issue unless otherwise stated.
3.2 Quotations are based on the scope of work visible at the time of inspection. Should hidden defects or additional work become apparent, we will notify you immediately and provide a revised quotation.
3.3 All prices are quoted exclusive of VAT unless otherwise stated. VAT will be added at the prevailing rate.
3.4 We reserve the right to adjust prices if material costs increase by more than 10% between quotation and commencement of work, with your prior agreement.
4. Payment Terms
4.1 A deposit of 25% is required for projects exceeding £1,000, payable upon acceptance of our quotation.
4.2 For projects lasting more than two weeks, interim payments may be requested based on completed stages of work.
4.3 Final payment is due within 7 days of project completion unless otherwise agreed in writing.
4.4 Payment can be made by bank transfer, cheque, or cash. Credit card payments may incur a processing fee.
4.5 Late payments will incur interest at 4% above the Bank of England base rate.
5. Customer Responsibilities
5.1 You must provide clear access to all work areas and remove or protect valuable items.
5.2 You are responsible for obtaining any necessary planning permissions, listed building consent, or other regulatory approvals.
5.3 You must inform us of any hazards including asbestos, lead paint, or structural issues.
5.4 Parking arrangements or permits required for our vehicles are your responsibility unless otherwise agreed.
6. Cancellation Policy
6.1 You may cancel the contract within 14 days of acceptance ("cooling-off period") without penalty, unless work has commenced with your express consent.
6.2 Cancellations after the cooling-off period or after work has commenced will be subject to payment for all work completed and materials purchased.
6.3 We reserve the right to cancel the contract if payment terms are not met or if site conditions prevent safe working.
7. Warranties and Guarantees
7.1 We guarantee our workmanship for 24 months from completion, excluding normal wear and tear.
7.2 Our guarantee does not cover defects arising from substrate failure, structural movement, or customer-supplied materials.
7.3 Any defects must be notified to us in writing within 7 days of discovery.
7.4 Manufacturer warranties on materials will be passed on to you where applicable.
8. Limitation of Liability
8.1 We maintain public liability insurance of £5 million and employers' liability insurance of £10 million.
8.2 Our liability for any claim shall not exceed the total value of the contract.
8.3 We are not liable for indirect or consequential losses, including loss of profits or business interruption.
8.4 We are not responsible for matching existing paintwork or wallpaper unless specifically agreed in writing.
9. Health and Safety
9.1 We comply with all relevant health and safety legislation including CDM Regulations where applicable.
9.2 You must keep children and pets away from work areas during our operations.
9.3 We will notify you of any specific safety requirements or restrictions during the work.
10. Subcontractors
10.1 We reserve the right to use qualified subcontractors for specialist work.
10.2 All subcontractors are fully insured and work to our quality standards.
10.3 We remain fully liable for all subcontracted work.
11. Intellectual Property
11.1 Any designs, colour schemes, or creative work we produce remain our intellectual property until full payment is received.
12. Complaints Procedure
12.1 Any complaints should be raised immediately with our site supervisor or project manager.
12.2 Formal complaints should be submitted in writing to our registered office within 14 days.
12.3 We will acknowledge complaints within 3 working days and aim to resolve issues within 14 days.
12.4 If you remain dissatisfied, you may refer the matter to alternative dispute resolution.
13. Data Protection
13.1 We process personal data in accordance with the Data Protection Act 2018 and UK GDPR.
13.2 Your information will only be used for the purposes of delivering our services and will not be shared with third parties without your consent, except where required by law.

14. Force Majeure
14.1 We shall not be liable for delays or failure to perform due to circumstances beyond our reasonable control, including extreme weather, pandemic restrictions, or material shortages.
15. Variation
15.1 These Terms may only be varied in writing signed by both parties.
15.2 No waiver of any term shall be deemed a waiver of any other term or of the same term on another occasion.
16. Governing Law
16.1 These Terms are governed by English law.
16.2 Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
17. Entire Agreement
17.1 These Terms, together with our quotation, constitute the entire agreement between the parties.
17.2 These Terms supersede any previous agreements or understandings.
